TERMS AND CONDITIONS OF SERVICE
Effective Date: July 31, 2026
These Terms and Conditions ("Terms") govern all electrical work, estimates, service calls, and related services (collectively, "Services") provided by Komas Electric LLC ("Komas Electric," "we," "us," or "our") to any residential or commercial customer ("Customer," "you"). By requesting, scheduling, or accepting Services from Komas Electric, you agree to these Terms.
1. LICENSING AND QUALIFICATIONS
Komas Electric LLC is a Wisconsin limited liability company holding a Wisconsin Electrical Contractor license issued by the Department of Safety and Professional Services (DSPS). Our qualifying Master Electrician also holds a Wisconsin UDC (Uniform Dwelling Code) Electrical Inspector certification. Copies of our current license and insurance certificates are available to Customer upon request.
2. SERVICE AREA
We provide Services within our core service area (Jefferson, Rock, Dane, Waukesha, Dodge, Walworth, Columbia, and Washington Counties) at no additional travel charge. Service in surrounding counties is available subject to an additional travel fee, which will be disclosed prior to scheduling. Service outside our standard coverage area is provided at our discretion and may be subject to additional charges.
3. ESTIMATES AND QUOTES
Estimates provided by Komas Electric are based on the information available and visible conditions at the time of the estimate. Final pricing may vary if additional work, materials, or code-required corrections are identified once work has begun. We will make reasonable efforts to notify Customer of any material change in scope or price before proceeding, and will obtain Customer's approval before performing work materially beyond the original estimate.
4. SCHEDULING AND CANCELLATION POLICY
We ask for at least 24 hours' notice if you need to cancel or reschedule a scheduled appointment. Cancellations made with less than 24 hours' notice, or missed appointments ("no-shows"), may be subject to a cancellation fee of up to $50, at our discretion, to help offset the time set aside for your appointment. We understand that unexpected situations arise and will work with Customer in good faith regarding any cancellation.
Komas Electric will make reasonable efforts to arrive within the scheduled time window. If we are unable to keep an appointment, we will notify Customer as soon as reasonably possible and reschedule at no charge to Customer.
5. PAYMENT TERMS
Unless otherwise agreed in writing, payment is due upon completion of Services. We accept payment via credit/debit card, ACH bank transfer, or check. A deposit may be required for larger projects or special-order materials, which will be disclosed prior to scheduling such work.
Applicable Wisconsin sales tax will be added to invoices where required by law. Real property improvements (such as new wiring, panel installations, and similar work that becomes a permanent part of the structure) are generally not subject to sales tax on labor or materials billed to Customer; however, certain repair, maintenance, and personal-property-related services are subject to Wisconsin sales tax on the full invoice amount, including labor, in accordance with Wisconsin Department of Revenue regulations.
Invoices not paid within 30 days of the invoice date may be subject to a late fee of 1.5% per month (or the maximum allowed by Wisconsin law, if less) on the outstanding balance.
6. WARRANTY
Komas Electric warrants that all workmanship will be free from defects for a period of one (1) year from the date of completion, unless a different warranty period is specified in writing for a particular job. This warranty covers defects in our workmanship only and does not cover: (a) damage caused by misuse, alteration, or work performed by others after our completion of the job; (b) manufacturer defects in materials, fixtures, or equipment not manufactured by Komas Electric (which remain subject to the manufacturer's own warranty, if any); (c) pre-existing conditions not caused by our work; or (d) damage caused by acts of nature, power surges from the utility, or events outside our reasonable control.
To make a warranty claim, Customer should contact Komas Electric as soon as reasonably possible after discovering the issue. We will inspect and, at our discretion, repair or correct any covered defect at no additional charge for labor.
7. PERMITS AND CODE COMPLIANCE
Komas Electric will obtain and pay for required electrical permits as part of the scope of work, unless otherwise agreed. Customer agrees to provide reasonable access to the property for any required inspections. All work is performed in accordance with the National Electrical Code (NEC) and applicable Wisconsin and local amendments in effect at the time of installation.
8. CUSTOMER RESPONSIBILITIES
Customer agrees to: (a) provide safe and reasonable access to the work area; (b) disclose any known hazardous conditions (including but not limited to asbestos, mold, or structural concerns) prior to commencement of work; (c) secure or remove pets and personal property from the work area as reasonably requested; and (d) ensure that any areas requiring follow-up access (such as for inspections) remain reasonably accessible.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by Wisconsin law, Komas Electric's total liability for any claim arising out of or related to the Services shall not exceed the total amount paid by Customer for the specific Services giving rise to the claim. Komas Electric shall not be liable for indirect, incidental, consequential, or special damages, including but not limited to loss of income, loss of use, or damage to property not directly caused by our negligence.
Nothing in these Terms is intended to limit liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded or limited under Wisconsin law.
10. INSURANCE
Komas Electric maintains general liability insurance and a contractor license bond as required by the State of Wisconsin. Certificates of insurance are available upon request.
11. CHANGE ORDERS
Any changes to the agreed scope of work requested by Customer after work has commenced will be documented and may result in additional charges and/or changes to the completion timeline, which will be communicated to Customer before proceeding.
12. DISPUTE RESOLUTION
In the event of a dispute regarding Services or invoicing, Customer agrees to first contact Komas Electric directly to attempt to resolve the matter in good faith before pursuing any other remedy. These Terms shall be governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any legal action arising from these Terms shall be brought in a court of competent jurisdiction in Jefferson County, Wisconsin.
13. PHOTOGRAPHS AND TESTIMONIALS
Komas Electric may photograph completed work for our own business and marketing purposes, including our website and social media. We will not use photographs that identify Customer's specific address or include Customer's likeness without separate consent. Customer testimonials will only be used with Customer's express permission.
14. ENTIRE AGREEMENT
These Terms, together with any signed estimate, invoice, or written agreement for a specific job, constitute the entire agreement between Komas Electric and Customer regarding the Services, and supersede any prior oral or written understanding. If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
